On additional measures for the protection and regulation of rational use of underground water resources
In order to further improve the system of using and drilling groundwater wells in the republic, strengthen state and public control over the protection of groundwater resources, widely promote the culture of rational water use among the population, prevent their quantitative decrease and pollution, and ultimately provide the population with high-quality drinking water in the long term:
1. To approve the List of territories with declining groundwater levels, where a moratorium on drilling wells and using groundwater is introduced, in accordance with Appendix No. 1 .
Determine that, starting from January 1, 2023:
a) in areas where the water level has dropped by more than 5 meters relative to the long-term average groundwater level, it is prohibited to issue a hydrogeological report for the purposes of land irrigation and production, to drill groundwater wells and to use existing wells for land irrigation without water-saving technologies, with the exception of drilling wells up to 25 meters deep within the framework of approved state programs and by individuals, as well as the individual withdrawal of groundwater in a volume of up to 5 cubic meters per day for personal needs;
b) a hydrogeological conclusion on drilling underground wells for groundwater and a special permit for water use in areas where the water level has dropped to 5 meters relative to the long-term average groundwater level are issued by the State Committee for Geology and Mineral Resources (hereinafter referred to as the State Committee on Geology):
for the purpose of irrigating agricultural lands - subject to agreement with the Ministry of Water Management on the terms of the introduction of water-saving technologies;
for production needs - in agreement with the Council of Ministers of the Republic of Karakalpakstan, the khokimiyats of the regions and the city of Tashkent under the terms of regional programs for the development and economical use of water;
c) the imposition of a ban on the operation of boreholes in the event of failure to use water-saving technologies (drip, sprinkler, discrete, etc.) for irrigation of agricultural crops is carried out by the Inspectorate for the Control of Mining and Geological Activities under the State Committee on Geology (hereinafter referred to as the Inspectorate).
2. Establish a procedure according to which, starting from April 1, 2023:
the current procedure for issuing permits for drilling groundwater wells is cancelled and a procedure for issuing permits by the State Committee on Geology to legal entities and individual entrepreneurs (hereinafter referred to as drilling entities) for the activity of drilling groundwater wells is introduced;
drilling entities are obliged to equip the drilling equipment under their control with GPS trackers and to maintain them in good working order at all times;
drilling of groundwater wells using drilling equipment that does not have the appropriate technical documentation required by law is prohibited and, if the Inspectorate discovers such facts, an application for confiscation of the drilling equipment is filed with the court;
failure to comply with the requirements and conditions of a permit for groundwater well drilling activities is grounds for suspension of its validity, and conducting drilling operations without a hydrogeological report is grounds for cancellation of the permit;
all users of groundwater who have structures for collecting groundwater (drilling wells, spring catchments) are required to submit a report on the annual volume of water intake to the regional hydrogeological stations of the State Committee on Geology in the established manner;
Prospective programs for improving water supply using groundwater, developed by ministries and departments, the Council of Ministers of the Republic of Karakalpakstan, regional khokimiyats and the city of Tashkent, are subject to approval by the State Committee on Geology.
3. To approve the Plan of comprehensive measures for the rational use of water and prevention of a decrease in the water level in areas with a declining groundwater level in accordance with Appendix No. 2 .
To assign responsibility to the heads of relevant ministries and departments for the timely and high-quality implementation of the measures provided for in the comprehensive measures plan.
4. The State Committee on Geology, together with the Ministry for the Development of Information Technologies and Communications, in order to establish online monitoring of the state of groundwater and the changes occurring in it, shall ensure:
organization, by May 1, 2023, of the activities of a situation center equipped with modern equipment and software, for the preparation of a digital database and an interactive map of groundwater monitoring by the State Unitary Enterprise Uzbekhydrogeology as part of the State Committee on Geology;
integration of the created electronic database of groundwater users starting from May 1, 2023 with the databases of the State Tax Committee.
5. The Council of Ministers of the Republic of Karakalpakstan, the khokimiyats of the regions and the city of Tashkent, the Ministry for the Support of the Mahalla and the Elderly shall ensure that members of citizens' assemblies submit information on cases of drilling groundwater wells in the territories assigned to them to the Inspectorate or regional hydrogeological stations from the date of the official publication of this resolution.
6. Determine that:
in order to maintain accurate records of groundwater use, groundwater users are required by 1 January 2024 to equip the groundwater intake facilities under their control with water metering devices in the established manner;
Starting from January 1, 2024, groundwater users are prohibited from using groundwater intake structures that are not equipped with water metering devices (with the exception of individual groundwater intake in a volume of up to 5 cubic meters per day for personal and household needs by individuals).
7. To the State Tax Committee:
ensure the sealing, registration and monitoring of the working condition of water metering devices installed at water intake facilities by groundwater users;
take measures to collect a tax payment in the amount of five times the established tax rate for water intake by groundwater users without water metering devices.
8. Agree with the proposals of the Ministry of Economic Development and Poverty Reduction and the State Committee on Geology:
on the introduction of 13 inspector positions into the Inspectorate’s staffing schedule by reducing the number of management personnel of the system’s organizations in proportion to each other in order to strengthen state control in the area of drilling groundwater wells and their effective use in the regions;
on the organization of a unified system for monitoring groundwater and hazardous geological processes in the republic through the transfer of the state institution “State Service for Monitoring Hazardous Geological Processes” to the State Unitary Enterprise “Uzbekgidrogeologiya”.
9. State Committee on Geology:
a) by 1 January 2023, submit to the Cabinet of Ministers a draft law on amendments and additions to legislative acts to significantly increase liability for illegal drilling of wells and the use of groundwater, failure to comply with the requirements of instructions for the prevention of hazardous geological processes, as well as on referring such cases of administrative offences to the jurisdiction of the Inspectorate;
b) by January 30, 2023, submit to the Cabinet of Ministers a draft government decision on the approval of administrative regulations for the provision of public services for issuing permits for the drilling of groundwater wells, as well as the procedure for installing and using water metering devices at groundwater intake structures;
c) starting from January 1, 2023, together with the Ministry of Internal Affairs and the Ministry of Defense, in order to identify legal entities and individual entrepreneurs engaged in drilling groundwater wells, form a single electronic database of special vehicles (equipment for drilling groundwater wells) in the republic;
d) strengthen state monitoring of groundwater in areas with declining water levels, and, based on its results, annually, by 1 April, submit to the Cabinet of Ministers substantiated proposals providing for:
continuation, easing or cancellation of established restrictive measures in the territories;
change in the area of territories where restrictions are applied, or inclusion of new territories;
the application of additional measures, as well as other issues related to the protection and rational use of groundwater in these areas.
At the same time, the Cabinet of Ministers shall take measures to amend and supplement the areas of territories where a moratorium has been introduced and the corresponding restrictions in accordance with the proposals submitted;
d) ensure the publication of annual information on the territories where a moratorium has been introduced on its official website and in other open sources not prohibited by law;
e) carry out geological exploration work in 2023–2027 to fundamentally reassess the resources of underground water deposits with declining water levels and intensive exploitation within the framework of annual state programs for the development and reproduction of the mineral resource base.
10. In order to implement advanced foreign experience in the field of geological research in the field of groundwater, protection and rational use of water resources, the State Committee on Geology, together with experienced consultants in the industry:
within two months, organize the activities of the State Geological Monitoring Service as a structural subdivision of the State Unitary Enterprise Uzbekhydrogeology, aimed at monitoring the state of groundwater and its effective use, protecting the population and facilities from possible hazardous geological processes;
in order to fundamentally modernize the State Geological Monitoring Service, provide in the draft state program for the development and reproduction of the mineral resource base for 2023 for its provision with modern communications, a mobile laboratory, measuring and monitoring instruments, equipment and vehicles;
by April 1, 2023, organize the equipping of drilling equipment of the subordinate hydrogeological enterprise with GPS trackers, as well as the implementation of their online monitoring;
starting from 2023, ensure the exchange of experience with foreign industry organizations and the advanced training of talented young specialists abroad on a systematic basis.
11. To approve the Plan of practical measures for the protection and rational use of groundwater resources in the regions in accordance with Appendix No. 3 .
12. To the Council of Ministers of the Republic of Karakalpakstan, khokimiyats of regions and the city of Tashkent:
within one week, approve “road maps” for the protection and rational use of underground water resources in the relevant territories based on Appendix No. 3 to this resolution;
together with the Inspectorate, the State Tax Committee, the State Committee for Ecology and Environmental Protection, strengthen on an ongoing basis control over cases of illegal drilling of wells and extraction of groundwater and take effective measures.
13. The National Television and Radio Broadcasting Company of Uzbekistan, together with the State Committee on Geology, the State Committee on Ecology and Environmental Protection, the Ministry of Housing and Public Utilities, the Ministry of Water Resources, the Council of Ministers of the Republic of Karakalpakstan, the khokimiyats of the regions and the city of Tashkent, shall ensure the preparation and broadcasting on a systematic basis of television and radio programs on current issues in the field of protection and rational use of underground water resources.
14. To amend some decisions of the President of the Republic of Uzbekistan and the Government of the Republic of Uzbekistan in accordance with Appendix No. 4 .
15. To recognize some decrees of the President of the Republic of Uzbekistan as no longer in force in accordance with Appendix No. 5 .
16. To assign personal responsibility for the effective organization of the implementation of this resolution to the Deputy Chairman of the State Committee on Geology A.A. Kadirkhodjaev, the First Deputy Minister of Water Management A.S. Nazarov and the First Deputy Chairman of the State Tax Committee M.M. Mirzaev.
Discussion of the progress of the implementation of this resolution, coordination and control over the activities of responsible departments shall be assigned to the Advisor to the Prime Minister of the Republic of Uzbekistan on the development of geology, mining and metallurgy and industry B.F. Islamov.

on the liquidation, in accordance with the established procedure, of abandoned, ownerless and unusable water intakes of the State Committee on Geology;
